About the Role

This is an exciting role to lead the Suntera Cayman Compliance function.  This role is suited to someone who has excellent industry experience at a senior compliance level, ideally from an international or global financial services provider. 

In this role, you will lead the Cayman Compliance team of four people and act as the AMLCO and MLRO for Suntera Cayman. There may also be a need to act as DMLRO to our sister offices in the Americas region. You will be a member of the Cayman and Caribbean Senior Management team, as well as part of the global Compliance team and will report to the Global Head of Compliance.

Duties and Responsibilities as AMLCO/Compliance lead: 

  • Act as designated AMLCO in line with the Cayman Anti-Money Laundering Regulations
  • Act as the Compliance Manager in line with the Statement of Guidance on Internal Controls for Trust Companies
  • Work constructively and openly with the Suntera Cayman Statutory Auditors and Internal Auditor
  • Act as an excellent team leader, supporting the team to successfully deliver tasks
  • Maintain strong positive relationship with the Cayman Board members and relevant regional and global personnel
  • To monitor the regulatory environment and changes therein and advise the board on the regulatory requirements of the Company
  • Own and maintain the Cayman Compliance framework, in line with local regulatory requirements in internal global best practice
  • To advise the board on risk management within the Company
  • Manage the AML/CFT Business Risk Assessment and Compliance Risk Assessment, supported by Global Compliance
  • To formulate and promulgate Company Compliance/Risk Management policy and procedures; Provide input on trust policies and procedures
  • Manage and participate in the successful delivery of the annual compliance monitoring programme
  • Maintain an open and positive relationship with CIMA and manage regulatory communications
  • Recommends amendments to and review any updates to operating procedures to ensure compliance aspects are taken into consideration
  • Follow up on recommendations of regulatory examinations to resolution and monitor to ensure on-going adherence
  • Exercises due diligence and minimizes risk relative to all aspects of the business including portfolio quality, account opening, anti-money laundering, anti-terrorism, suspicious activity, financial sanctions,
    and fraud as outlined in Suntera’s instructions and guidelines
  • Ensure that all requirements are met in accordance with internal policies in relation to Know Your Client understanding and supporting documentation
  • Maintain awareness areas of operational risk or potential losses
  • Recommend and implemented action plans to address and/or correct

As MLRO, you will:

  • Act as designated MLRO in line with the Cayman Anti Money Laundering Regulation
  • Maintain appropriate independence from customer-facing and business development roles
  • Review internal STRs and supporting information and documentation and to conduct independent investigations for the purposes of determining the need to file a STR with the local Financial Intelligence Unit
  • Act as the liaison point with the FRA and CIMA as appropriate, and lead on responding to law enforcement production orders
  • Report directly to the Board on a quarterly basis or as required, and escalate relevant issues directly to the Board at appropriate times outside of board meetings
  • Provide advice to the business administration teams in the ongoing and effective management of client relationships to avoid tipping off
  • Participate in the local committees as required
  • Lead or participate in the delivery of AML/CFT training to new/ existing employees
  • Conduct ongoing monitoring of all individuals linked to an existing STR through using external databased adopted by Group
  • Review payments or other activities requiring MLRO oversight
  • Maintain a list of Deputy MLROs and appropriately manage and review the performance of the DMLROs, including considering and determining that STRs are being handled in appropriate and a consistent manner
  • Maintain full awareness of personal and Suntera obligations under relevant AML/CFT legislation and emerging best practice issued by local regulations or law enforcement agencies
  • Where and when required, act as Deputy MLRO to MLROs in Suntera offices across the Americas region

About you

You will be a dynamic and self-motivated individual with excellent leadership and communication skills. The following attributes would also be advantageous:

  • A degree (minimum BAC+3 or equivalent) in a related field and a relevant ACAMS qualification
  • At least 7 years of experience in a similar position in a trust and mutual fund provider, ideally one that is part of an international or global group
  • Excellent knowledge and practical application of relevant Cayman legal and CIMA/FRA regulatory requirements
  • A track record in balancing the application of Cayman legal and CIMA/FRA regulatory requirements and Group requirements in the commercial environment
  • You must be able to work independently and supervise the administrative staff in compliance matters
  • Good knowledge of standard computer tools including Microsoft Office
  • You must have a track record of being able to build and maintain excellent relationships with the Cayman Board members and other regional and global personnel
